The Care Quality Commission (CQC) has expressed concerns that people are being detained in England under the Mental Health Act without their legal rights being discussed or explained to them. They are also being detained without being fully assessed for their willingness and ability to consent to their treatment, and not always having easy access to appropriate independent advice.
